Laws on silence in Russia
The Russian government passed a resolution on maintaining silence on November 15, 2005, to control noise in residential buildings caused by maintenance or household chores. A short while later, the Moscow Law on Noise, also known as Law on Silence No. 42, was enacted in accordance with this resolution.
What is it? What is the purpose of the law? The law stipulates hours and times when it is permissible to make noise, as well as when it is prohibited to watch videos or listen to music loudly in Moscow and other major Russian cities. The law also lists exceptions and categories of sounds that are not allowed to be played at night. The goal is to regulate quiet for citizens’ everyday lives.
Such a law was amended in 2019, but the meaning and majority of the provisions remain the same.
To which time and on what days you can make noise
Laws governing quiet in Moscow make distinctions between the permissible levels of noise on weekdays, public holidays, and official days off. Let’s examine the clauses:
- at night (from 7.00 to 23.00 pm) you cannot make noise if the sounds can be heard by neighbors behind the wall, listen to loud music in the car and public places, and also use car horns in the courtyards;
- quiet time from 13.00 to 15.00 on weekdays;
- on weekdays it is allowed to make noise from 9 am to 9 pm, on weekends this time is extended until 22.00.
Nonetheless, the authorities seem to think that noise can only be produced until 19.00 on weekdays and weekends due to the changes made to the law in 2019. Additionally, state-designated holidays, such as Sundays, are off-limits for 24/7 repairs and reorganizations. Additionally, the Law on Noisy Works mandates that construction and repair activities cease between the hours of 13.00 and 15.00 (the time when children should be sleeping) and precisely between 19.00 and 9.00 am.
When it comes to construction, work is possible from 7 a.m. to 11 p.m. If the builders are working at other times and the noise bothers the occupants of nearby homes or apartments, you can safely file a complaint.
The law prohibiting noisy work stipulates that construction or repair work must be silent from 13:00 to 15:00 and from precisely 19:00 until 9:00 am.
Noise standards
In Moscow, there are also noise regulations that need to be followed.
- The maximum noise level in the daytime is 55 decibels according to GOST. At night the level decreases to 45 decibels. But given that human whispering or the rustling of leaves already produces a noise of 40 decibels, these figures need to be observed only when such a noise level also occurs among neighbors behind the wall. And they usually don’t hear that much noise.
- In the afternoon, the noise level near the residential building in Moscow and the region should be 70 decibels, at night – no more than 60.
- In secondary, specialized and higher educational institutions, the maximum noise level is about 55 decibels both during the day and at night.
Using a noise meter, you can determine the noise level on your own. Please be aware that if you are next to a car alarm, the noise level is 80 decibels if you do not have the opportunity or need to purchase one.
Wall finishing can present serious challenges due to "noisy work," which can disturb nearby residents as well as the workers on the job site. Knowing how to control and reduce noise can have a significant impact on upholding amicable relations with neighbors, abiding by the law, and establishing a more comfortable work environment. There are useful ways to control noise levels while completing tasks quickly, such as selecting quieter tools, planning tasks during appropriate times, or employing soundproofing methods.
Exceptions
What are the exceptions to the legal threshold for loudness on weekends and holidays? First and foremost, these are fixes that are required to guarantee the security of the home’s occupants. Second, efforts to prevent and eradicate natural disasters are included in the exception list. Thirdly, there’s a chance that legal religious organizations’ events will have a little bit too much noise.
On Saturdays, regular people are allowed to make more noise if absolutely necessary.
Responsibility for violation of the hours of silence
The following kinds of fines are stipulated for the offense of disturbing the peace in Article 3.13 of the Code of Administrative Offenses of the Russian Federation:
- a fine from 1,000 to 2,000 rubles for citizens;
- a monetary fine from 4,000 to 8,000 rubles for official organizations and their managers;
- a fine from 40,000 to 80,000 rubles for organizations and individual entrepreneurs.
The type of work that produced the noise, the day and time of the disturbance of the peace, and the number of times a person has been found guilty of a similar offense are all considered when determining the appropriate fine. The source of the noise will also determine the amount of the fine and any further penalties. It is not guaranteed that those who commit acts such as shooting with a weapon or fighting will only receive a fine for making noise. The majority of the time, the punishment consists of jail time or even hard labor.
Who and in what cases to complain to
It makes sense to file complaints about disturbing the peace with a number of organizations given Moscow’s noise standards and the nature and volume of noisy work.
- If the source of increased or dangerous noise levels is located behind a wall at the neighbors, inside or near the entrance, in the yard or at a nearby construction site, the police are contacted regarding violations. The local police officer conducts a preventive conversation with the violators and, if necessary, draws up a report on them.
- To check the legality of the neighbors" repairs, if they break down the walls, a complaint is filed with the Moscow Housing Inspectorate. You can also complain about violators on the Moscow online portal "Our City".
- In case of noisy garbage removal by truck at night, complaints are filed with the OATI or letters are sent to the electronic reception.
- In case of noise at construction sites near a residential area for a time not established by law, a complaint is filed with the Department of Nature Management.
- If a residential building is located near public places that make noise or strong odors at the wrong time, then you can complain about them to Rospotrebnadzor or the Moscow Road Administrative Inspection – it all depends on the type of establishment and the nature of the noise. If explanatory talks or drawn up protocols do not yield tangible results, then by decision of the court, the culprit of the noise is fined.
If the case has progressed too far, you can file a direct complaint with the court. In order to accomplish this, you must sue the offenders and wait for the judge to summon you to discuss the case. At this point, it is advisable to gather proof of the legal infraction to ensure the claim is not rendered moot.
Regarding complaints, you can report violators anonymously or provide personal and passport information on online portals. Experience has shown that anonymous complaints are typically not followed up on. When multiple citizens file complaints at once, they are taken into consideration right away, and the authorities take more time to decide who is breaking the Law on Silence.
